1. Agreement to Terms

These Terms and Conditions ("Terms") govern your use of the website https://plota.app and the eSIM purchase and delivery services (the "Service") operated by Design & Desktop, LLC, a Delaware LLC. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

Plota provides an online marketplace for purchasing and receiving travel eSIM (embedded SIM) data plans. After purchase, you receive access to eSIM installation instructions and QR codes (or equivalent) to activate data on compatible devices. The Service is offered "as is" subject to availability and the terms of our eSIM suppliers.

3. Eligibility and Accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for keeping your account credentials secure and for all activity under your account. You must provide accurate information when creating an account or making a purchase.

4. Orders, Payment, and Pricing

All orders are subject to acceptance and availability. Prices are displayed in the currency shown and may vary by region. Payment is processed via our payment provider (e.g. Stripe). You agree to pay all fees and applicable taxes. We reserve the right to correct pricing errors and to change prices with notice where required by law.

5. Refunds and Cancellation

Because eSIMs are digital products that can be activated immediately, we generally do not offer refunds once the eSIM has been delivered or activated. Refund requests may be considered on a case-by-case basis for technical failures or duplicate purchases. Our refund policy is detailed on the Service and may be updated from time to time.

6. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not: (a) use the Service in any way that violates applicable laws; (b) attempt to gain unauthorized access to any part of the Service or related systems; (c) resell or redistribute eSIMs in a manner that violates our or our suppliers' terms; or (d) use the Service to transmit malware or to interfere with the integrity of the Service.

7. Intellectual Property

The Service, including its design, text, graphics, logos, and software, is owned or licensed by Design & Desktop, LLC and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent. The Plota name and branding are our trademarks.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. eSIM coverage and performance depend on third-party networks and suppliers; we do not guarantee coverage in any specific location.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DESIGN & DESKTOP, LLC AND ITS AFFILIATES, OFFICERS, AND EMPLOYEES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in such courts.

11. Changes to Terms

We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms. Material changes may be communicated via email or a notice on the Service where required by law.
